H-1B premium processing suspended for 6 months

H1B premium processing suspended

From 3rd April 2017, the United States Citizenship & Immigration Services will suspend all H1B Visas for Premium processing. This is a temporary suspension which may last for approximately 6 months.

Since premium processing is suspended, the individuals applying may not be able to file Form I-907 and Form I-129. USCIS has stated that it will notify people before resuming premium processing for H-1B petitions.

Who Is Affected by this Decision:

This temporary suspension applies to all individuals who apply H-1B on or after April 3, 2017. So no one can apply H-1B under premium processing. This applies for both the techies who are working and for the Students who are planning to apply under masters cap.

USCIS has stated that any application with Form I-907 will be rejected. It has also stated that “We will continue to premium process Form I-129 H-1B petitions if the petitioner properly filed an associated Form I-907 before April 3, 2017. “

USCIS will reject the form and will refund the money back if the petition is filed after 3rd April 2017.

The United States Citizenship & Immigration Services has stated this temporary suspension is to reduce overall H-1B processing times.Since there are long-pending petitions which they have been currently unable to process and rise in the numbers of premium processing petitions is increasing year after year.
